Terms Of Service
By signing up and actively using the x-mails.biz program you agree to all terms and conditions
set forth in this agreement. x-mails.biz may, at any time, choose to edit, add and/or delete
portions of this agreement and impose changes without prior notification of its
members. Members will be informed of any and all changes to this policy via an
email to their primary contact email address provided upon signing up with x-mails.biz.
If any modification is unacceptable to you, your only recourse is to terminate
this agreement. Your continued participation in the x-mails.biz program following our posting
of a change in policy notice or new agreement on our site will constitute binding
acceptance to the change.
Responsibility of Members:
You must be 13 years of age or older to participate in this program. Our program
is open to both US and International members and is void where prohibited by local
governing laws.
You agree to and must use your own name and email address in the sign-up process
and may not assume a false identity. You may not sign-up multiple times with different
email addresses. Your computer must not be shared with another individual that
has an existing x-mails.biz account.
You will use your email address / password combination to access your account,
it is your responsibility to keep this information confidential, you may change
this information by logging into your account and following the "User Account
Info." link.
You are solely responsible for any and all use of your x-mails.biz account including authorization
by you to any third party individual who may use your account.
Should any instances of fraud, system abuse, or any type of activity deemed to
be inappropriate or illegal by x-mails.biz be detected it may result in member termination
and possible legal action. Any solicitation of advertisers for a confirmation
email for purposes of receiving credit in your account will be grounds for immediate
termination.
You must maintain your email account that you used when signing up x-mails.biz. You must
maintain your e-mail account that you used when signing up with x-mails.biz. You agree
to receive e-mail advertising from x-mails.biz. limited to no more than 30 per day.
In the event your e-mail account on file becomes closed or blocked to messages
from x-mails.biz, your account will be terminated. This especially applies to e-mail accounts
returned for being Full. Any member sending us gibberish will result in automatic
termination of account and Forfeiture of All earnings to date of termination.
Auto-responses will also be deleted immediately.
Relationship of the Parties:
You and x-mails.biz are independent contractors, and nothing in this Agreement creates
any partnership, joint venture, agency, franchise, sales representative or employment
relationship between you and x-mails.biz. You understand that you do not have authority
to make or accept any offers or make any representations on behalf of x-mails.biz. You
may not make any statement, whether on your site or otherwise, that would contradict
anything in this section. You are solely responsible for the reporting and payment
of any taxes for money earned while using the program.
Limitation of Liability:
x-mails.biz will not be liable for lost profits, lost business opportunities, or any other
indirect, special, punitive, incidental or consequential damages arising out of
or related to this Agreement or x-mails.biz program, even if x-mails.biz has been advised of the
possibility of such damages. Furthermore, x-mails.biz aggregate liability arising under
this Agreement will not exceed the amount of the total fees paid or payable to
you under this Agreement. The provisions of this Section survive termination or
expiration of the Agreement.
Payments:
Members may earn by receiving paid-emails, credit emails and visiting
the advertiser websites after they have entered their member ID in the
area on the website provided by X-MailS. Members may earn by referring
new members to the X-MailS program. Members will earn 16% of their direct
referrals earnings, 8% of their 2nd level referral earnings, 3% of their
3rd level referral earnings, 1% of their 4th level referral earnings and
1% of their 5th and 1% of their 6th level referral earnings. Members will
be paid via E-Gold / WebMoney / MoneyBookers / PayPal.
X-MailS will pay members via E-Gold/PayPal
when their balance reaches $0.01 for e-gold and 3$ for paypal
and they request payment. Payments will be made within 30 days (PayPal - 60 days).
If you have not received payment during 21 days (PayPal - 41 days), enter contact with
admin.
To request payment you must be active atleast 0% from your downline.
About the order of execution of payment for the paid registrations read section
" Sign Up " on page TERMS.
Member from China and Thailand can join but they have to take permission from me
for payout otherwise they can only use their earning for redeem ads.
Spam:
You may not promote your referral links through unsolicited emailing (i.e. SPAMMING),
newsgroup postings, or any other method of mass communication. Failure to comply
will result in immediate termination of your membership with x-mails.biz and may result
in legal prosecution. x-mails.biz strictly enforces anti-Spamming laws. Spamming is a federal
crime. Any member caught Spamming will not only have their account terminated
immediately and lose any past, present and future earnings, but shall also be
held liable for Spamming as we shall cooperate with any authorities and investigations
that may arise from the Spamming incident. x-mails.biz may charge up to $5 per spam email
sent. Multiple sign-ups shall be grounds for immediate termination of all involved
accounts. Signing up multiple times from the same computer also constitutes fraud.
x-mails.biz will file charges for recovery of any earnings received from multiple sign-ups.
Search:
1. The interest "search" can be selected only members from countries
allowed to search (United States, Canada, Australia, Austria, Belgium,
Denmark, Finland, France, Germany, Greece, Iceland, Italy, Netherlands,
New Zealand, Norway, Portugal, Spain, Sweden, Switzerland and United
Kingdom.) and wishing to receive paid emails with the links to
retrieval programs, which can be used for search of the information,
interesting you, goods and services in the network internet.
2. The members selecting interest "search" are not obliged to search,
that is they can default search, but in this case they should not
push the link in email for obtaining money. If you have pushed the
link and have decided not, you can default search.
3. If the member of the program selecting interest "search"
permanently has no searches, thus regularly takes money for reading
emails, it can be forbidden to such member to select interest "search"
or him account can be remote (in this case member deceives the
advertizer, asserting, that wishes to receive paid emails with the
links to retrieval programs, which wants to use for search of his
interesting information, goods and services in the network internet,
but actually possibilities, granted him, for information retrieval,
goods and services does not use).
4. In case to you the choice of interest "search" you was is
prohibited can to request permission on repeated choice. In case the
choice of interest "search" to you was prohibited of second time - you
can not make this any more choice never. In case of independent
repeated choice of interest "search" yours account will be remote.
5. If you have selected interest "search" - that you should not use
proxy in an operating time with our mail and at reading emails. if you
can not refuse usage proxy in an operating time with our mail and at
reading emails - you should refuse choice of interest "search".
Sign Up:
Any member of our program can fulfil no more than 2 paid registrations (Sign Up)
per 1 day or no more than 4 paid registrations (Sign Up) per 1 week.
Money for the fulfilled paid registrations (Sign Up) will be added to your balance at
once after obtaining your confirmation email, but you can request this money for payment
only through 2 weeks from the moment of execution of registration, and you will be member
of our program not less than 1 month.
If you will be remarked in violation of the given TERMS or in attempt of illegal
obtaining of money for the incorrectly fulfilled or not fulfilled registration, you will
be fined on the sum equal to double cost of paid registration (Sign Up).
Your account will be suspend for followoing reasons:
- For inactivity greater than 45 days and deleted for inactivity greater than 60 days.
- We accept member from every country.
- Multiple account
- Same payment account
- Proxy user
- click bot user
- Illegal search country
- Bad keyword like (I am cheater) etc.
- More than 15 wrongturing click (account will be suspend) and more than 50 wrong turing number (account will be deleted)
- clicking more than 3 cheat links
